Getting Error when trying to show the sharepoint list toolbar

I have a simple site collection with a few sub site. At the root
level, I have a page that is shows list information using the dataview
web part. That is working fine. When I try to enable the Sharepoint
list toolbar (in SPD), it get rendering errors for the toolbar buttons
and the view selector control.

Is this by design since the data is in a subsite?
